What happens at Mediation?
Mediation is a process where a neutral mediator meets separately with each party to explore the issues in an open and candid way. With your attorney by your side, you’ll have the chance to address concerns and work toward resolving disputes step by step.
Throughout the process, each party usually remains in their own private room. This setup allows for confidential conversations between you and your attorney, so you can discuss options and strategies freely.
When an agreement is reached, it is compiled into a Mediated Settlement Agreement which is then signed by all parties, and becomes a legally binding document. This agreement brings the case to a final conclusion, ending further litigation.
Mediation provides significant advantages. It facilitates closure, promotes a balanced and thoughtful evaluation of each party’s position, and fosters an environment conducive to compromise. In my professional experience, parties who resolve their disputes through mediation tend to express greater confidence and satisfaction with the outcome, as they have actively participated in shaping the resolution rather than having a decision imposed upon them by the court.
